"Who gets to make that determination?" That's really the best question on this thread, because the answer pretty much exposes the silliness of most of the posts: the folks who send the checks to ConEd get to decide when to turn off their lights. Just as you get to decide whether to display Christmas lights in your lawn every December (assuming you have a lawn).
