The Lynch movie had a disclaimer on screen at the end of the film that said "This has been based upon the true life story of John Merrick, known as The Elephant Man, and not upon the Broadway play of the same title or any other fictional account."

I assume they added that to avoid litigation, even if they had every legal right to make a movie about John (Joseph) Merrick and call it The Elephant Man.
