Not quite the same thing. James Barbour was convicted, has completed his sentence, and is now a free man. The footballer in question is out on licence - he's still bound by his sentence, and can be returned to prison if he violates the terms of his parole.

(And this should not be taken as a statement either for or against Mr. Barbour joining the cast of 'Phantom'.)
