You have nothing to worry about. As long as your apartment is still your primary apartment while you're away, which it will be, and you don't earn anything on it while you're away, you are covered under Rent Stabalization guidelines. I was away at grad school for eight years, and had friends stay at my rent stabalized apartment while I was away with no problem. A few things to consider: some landlords are different than others, and some will use your absence as an excuse to make problems for you if they want to. This did not happen to me, but I've heard of it. It's illegal, but they may try. Be sure to pay the rent yourself while you're away, and on-time. Also, it's better if you have friends stay there, or friends of friends, rather than an official sublet, which is what I think you're suggesting. If it's someone you know, it's easier. Check the Rent Stabalization guidelines online and you'll see that what you're doing falls within accepted parameters. Also, contact the Tenants Association, and tell them your situation. They may have further advice. But you are not at risk of losing your apartment. Go for the bus and truck! If you have any further questions, don't hesitate to ask me here.

The above poster is incorrect. There are regulations for subletting a Rent Stabilized apartment - I just did so myself. You are allowed to sublet, but only for a max of 2 years out of a 4 year period (if you follow the law). Since i knew my landlord wanted me out so he could raise the rent for the next tenant, I let him know i was subleasing, etc.

If you do so, you might be limited to those two years. But the rent control law clearly says you have to notify you're subletting. If you don't you might be risking the apartment...

Wow. A lot of misinformation going back and forth here.

You are fine. Go and enjoy the tour. You have NOTHING to worry about. You can be gone for two years and as long as this is your PRIMARY residence and the one you will return to when the tour is over and you pay your taxes each year based at this address you will be fine. I know MANY actors who have had overzealous landlords try to evict then when they went to California to do a television series and as long as they never established a new Primary residence they won every case.
