| When a first national tour uses clips featuring the actors from the original B’way production, do the actors in the clips get any remuneration? | |

| Thats a good question. For non paid advertising, (website etc) the Producer can use footage of the original cast for productions that they do in the future, in perpetuity. They may be required to run a subtitle like (original 2007 Broadway Cast) As far as paid advertising goes (commercials), actors are paid SAG/AFTRA rates to make commercials, or have footage used in paid commercials. Again, the Producer can use this in perpetuity for the show, and SAG/AFTRA controls any residual payments due to the actors. The only AEA penalty I know of for using photos of actors no longer in the production is at the theatre. There is a penalty if a photo of an actor is left up outside theatre or anywhere front of house after the actor has left the production. There is a rule regarding this. Caveat. No footage of an Equity production, regardless of what you have read above, can be used to promote a non equity production. I'm sure someone out there will have more details! |

| Yes, everyone involved in anything union get paid. It's been little while since I was involved in this, but I'm remembering it's by multi-week periods like 4 or 6 weeks. This includes acting and music talent. So there is a payment that's made upfront for the time to shoot it. Then a payment that's done for a limited time frame (if the spot airs outside the timeframe, then the entire team gets paid for an additional time frame) and based on the geographical areas where the spot is playing (big city markets cost more than small city, national is of course the most expensive). There has to be a descriptor on the footage (Broadway Production Cast) so it allows the producers to not be guilty of false advertising if those actors (above title) aren't in the show in St. Louis. | |
