Of course DAVE is based (uncredited) on both a 1932 film, THE PHANTOM PRESIDENT (with George M Cohan in the Kevin Kline role, as well as Claudette Colbert and Jimmy Durante). The film was written by Walter DeLeon and Harlan Thompson, based on a 1932 novel by George F Worts. Both the novel, and screenplay, would be covered by copyright protection. And its possible that the studio and Gary Ross bought the rights under condition that they didnt have to provide credit of the source.

However, I imagine they did not do this - because in 1994 Gary Ross was nominated for an Oscar for the screenplay of DAVE, Screenplay Written directly for the Screen. And it wasn't. In any way shape or form.
