Gaston Leroux's 1910 novel THE PHANTOM OF THE OPERA and Joseph Moncure March's 1928 poem THE WILD PARTY are both in the public domain.
United Artists' 1959 film SOME LIKE IT HOT is not.

I assume that when someone creates a new work, the rights to source material is for as long as copyright exists. And mgm would still get royalties for sugar productiions.
