Free ticket policy at Shakespeare in the Park

I'm confused about what the policy is about the Public actually being permitted to sell tickets to performances in the Park. I know that "members" get what are referred to as "seats set aside." Plus, I know that big corporate contributors have a certain number of seats set aside. But actual tickets for sale? Is this new? I got an offer to buy seats at $199 each which also comes with a drink. I thought the use of the park prohibited this type of direct sale of tickets. Just like the Met Museum trying to charge New York taxpayers to enter the museum. I thought the Delacort, like the Met Museum, was limited to its commercial demand for prices for entry because the institution is using public lands.

How many tickets can the Public actually sell and thereby limiting the number of free tickets available to the public? Again, is this new? And has anyone challenged the legality of it?
