| You misapprehend the process. Judges are experts on the law, juries on the facts, and experts on what you call "the issues." A judge and jury apply the law and facts, as developed through the experts. A judge does not need to be (and indeed cannot be) the expert. The law is pretty damn clear; it's the application of the law to facts that gets murky sometimes. |
