Please name the cases where courts "rejected" a director's video as a tangible fixation of his or her staging. Such as decision would violate the statute. (Unless the video was created after the alleged infringement, in which case it would be too late.)

As I said, however, the video doesn't guarantee the scope of the copyright that the court will recognize. It only satisfies the fixation requirement. If a court rejects the director's claim of copyright on originality grounds (or on scene a faire, merger, or other recognized grounds), that is completely different, and is very case-specific.

So if you can point me to the cases, that would help clarify things.
