If you mean Einhorn v. Mergatoyd Productions, the court did not hold that directors can't have copyright. Einhorn simply didn't provide adequate evidence of original contributions. Much of his evidence involved stage directions that were already in the playwright's script.

I have yet to see a single case squarely rejecting the idea that a director can hold a copyright in creative expression that takes the form of staging. And even if one court did so hold, I would expect other courts to disagree, since it would not be supportable under the statutes.

So, again, if you can point me to a case stating that directors can't own copyright in their staging, that would be most helpful.
