Long running Broadway shows "closing" and "re-opening"

Reading about this agreement regarding the Broadway shutdown and wondering if there is anything prohibiting longer running shows without marquee names (such as Phantom or Chicago or Wicked) from "closing" to avoid paying staff and "re-opening" when Broadway is back, with a new cast or a cast made up of touring casts, etc. It seems underhanded yes, but couldn't they?
