They do not pay royalties or have permission.

A 'current' Broadway property could be vigilant protecting their image, banning individuals (DMCA claim) profiting from use of their intellectual property and siphoning off sales...for example you don't see the use of the Hamilton logo there and you'd think that might generate decent sales.

It becomes tougher to police for an older property...an individual artist has most likely given control (buyout) to a producer who has little incentive to protect the image. A licensing/publisher for secondary or grand rights doesn't have jurisdiction. Unless a first class revival or tour comes along and objects...but oftentimes they re-brand with a new image. An iconic brand will object and enforce...the Cats & Les Miserable branding comes to mind. Now & forever.
