I agree it is ugly, but it has nothing to do with blacklisting or McCarthyism and it is misleading (and potentially perilous) to suggest that it does. Only the confidantes who are dumb enough to use a phone sitting next to someone on a plane without spending $5 on a screen shield. I have not made an argument. I just offered a reality check in terms of what the law says. If you don't like the law, I encourage you to contact your legislator and ask them to support a change in notions that go back a century.
