| Well... I retracted "fired" and replaced it with "replaced" but I guess you were not satisfied. I did not look at the article you link, not because I was not able to find it but because it is not material to the question I was answering. What the production did was illegal. When an employer materially breaches a contract, as Kagan did here, the employee has been constructively terminated. There is no obligation on the part of an actor to renegotiate or to acquiesce in an illegal contract alteration and in fact Equity would carefully scrutinize it if they did because a producer cannot ask an actor to relinquish a performance. For whatever reason, you don't seem to want to accept this. The issue has nothing to do with whether they offer to pay during the "hiatus" (they do not have the option of not paying it anyway) and/or offer the original job back thereafter. It also, as you now seem aware, has nothing to do with any issues about Oak's performance. The production was in financial distress and its inexperienced and inept producer didn't know the right way to handle this. It remains a public example of a replacement (more accurately, an attempt at one) as a putative strategy for selling tickets. I used "fired" because that's the way the question was posed. I changed it because this was not a "firing in the conventional Donald Trump sense. To me, it was irrelevant, so I offered the change to make you happy. I failed. |
