Merged Rights Some Like It Hot

Why is there a new musical version of Some Like It Hot about to be produced. There is an already a musical version originally called Sugar but used Some Like it Hot as a title later. It was produced by David Merrick, directed/choreographed by Gower Champion and written by Jule Styne , Bob Merrill and Peter Stone. i am not arguing that it was a great or even good show. My question is aren't the rights merged? It ran for 505 performances (72-3) and usually merger occurs after 40 performances - standard contractual clause. Clearly Merrick et at had the clout to get at least the standard agreement if not something better. The show went through many changes during an extended out of town tryout. It is still performed (as per Concord Theatricals which now licenses it). Late in his life Tony Curtis toured in it playing the Cyril Ritchard role. It was titled Some Like It Hot. I saw the show early in its tryout in Toronto; it was a mess. But cast changes, new songs, new sets and whatever saw it enjoy ok reviews and, what then, would have been called a long run. Anyone know about this?
