Sorry for not explaining. Rights are merged when a derivative work and its underlying work are intertwined. That does not mesn they are one work A musical based on a play doesn't prevent the play from being performed. It does mean that the rights holder for the underlying work no longer can contract with others for another musical version without the agreement of the rights holder for the existing musical. Same with a film. When the rights for My Sister Eileen were obtained for Wonderful Town, film rights were not included so a different musical version was filmed. But only Wonderful Town is the only stage musical. And its been done on TV too. As. I recall a musical version of seventh Heaven was closed with. Cease and desist even though the rights to the underlying work were obtained because rights had merged with a previous musical -
A 1955 flop that had hung on long enough for the rights to merge.
