The nominations are no longer based on billing. That rule was discarded long ago when you had actors like Rita Moreno being put in supporting categories when they were indeed leads, as she was in The Ritz. These decisions of categories are decided by the nominating committee and producers can petition them, but it is that committee's final decision that rules. The nominating committee is then given those edicts by the nominating committee.
