This is correct and I don't know why it escapes quite a few others here.
That said, I do not agree with what you say elsewhere about "rules." The "rule" here is actually a contract provision, not just a custom. A breach is a breach is a breach. Complying with the contract does not intrude on artistic freedom; it just adds a price tag.
