If the theater notifies the drawee bank promptly of the forgery, they should be able to get their money back, barring allegations of fraud. It’s generally the responsibility of the drawee bank to verify signatures. I’m not sure the bank can successfully allege negligence on the part of the theater. Something’s off here, though. No bank is likely to cash a $40,000 check without verification, and if the funds went into an account there would have been a multiple day hold and they could likely be traced. If the bank plays hardball with the theater, they should seek legal advice.
